The Republican-led House Oversight Committee issued a bombshell report Tuesday, Oct. 28, declaring all executive actions and pardons signed by former President Joe Biden using an autopen “null and void,” citing concerns over his cognitive decline and the legitimacy of the decision-making process.
The committee urged Attorney General Pam Bondi to investigate whether Biden’s aides unlawfully exercised presidential authority while obscuring his deteriorating mental state.
The 93-page report, titled “The Autopen Presidency,” alleges that Biden’s inner circle concealed his declining health from the public and facilitated executive actions—including controversial pardons—without proper authorization. The committee’s findings raise alarming questions about who was truly running the country during Biden’s presidency.

The primary concern revolves around the potential misuse of this device to sign documents without fully understanding or approving their contents, which could have significant implications for policy and law.
The committee concluded that 4,245 pardons and commutations signed via autopen—including those for Hunter Biden, Dr. Anthony Fauci, General Mark Milley and members of the Jan. 6 Committee—should be invalidated due to Biden’s alleged inability to fully comprehend or authorize them.
The report states: “The Committee deems void President Biden’s executive actions that were signed using the autopen and determines that action by the Department of Justice is warranted.”
Investigators found no contemporaneous written records proving Biden personally approved the autopen-signed documents.
Former White House staffers testified that decisions were often conveyed orally, raising concerns about accountability. Neera Tanden, Biden’s former Domestic Policy Council director, admitted she did not always confirm Biden’s approval before using the autopen.
Three key Biden aides—Dr. Kevin O’Connor (Biden’s physician), Anthony Bernal (Jill Biden’s chief of staff) and Annie Tomasini (senior advisor)—repeatedly invoked the Fifth Amendment when questioned about Biden’s health and decision-making.
The committee has asked the D.C. Board of Medicine to investigate whether O’Connor violated ethical standards by allegedly misrepresenting Biden’s condition.
Biden issued sweeping pardons for family members, political allies and Jan. 6 investigators, claiming they were at risk of “politically motivated prosecutions” under Trump.
Justice Department Ethics Attorney Bradley Weinsheimer warned that some clemency recipients had violent criminal histories, contradicting Biden’s claim that they were “non-violent offenders.”
Biden has vehemently denied allegations that he was unaware of his own executive actions. In a June statement, he declared: “Let me be clear: I made the decisions during my presidency. Any suggestion that I didn’t is ridiculous and false.”
Democrats dismissed the report as a political stunt. Rep. Robert Garcia (D-CA), ranking member of the Oversight Committee, called it a “sham investigation” and accused Republicans of ignoring pressing issues like the government shutdown.
Legal experts caution that no precedent exists for invalidating a president’s pardons after leaving office. However, the committee’s findings could fuel legal challenges, particularly if evidence emerges that aides acted without Biden’s consent.
Trump-appointed Pardon Attorney Ed Martin signaled he would not defend Biden’s autopen pardons, stating in an email: “My office cannot support the validity of autopen pardons for individuals such as Anthony Fauci, Adam Schiff, Mark Milley and many more without further examination.”
The Oversight Committee’s report paints a damning picture of a presidency operated by unelected aides while Biden’s cognitive decline worsened. Chairman James Comer (R-KY) warned: “The Biden autopen presidency will go down as one of the biggest political scandals in U.S. history.”
